My Attorney said that if I pay them that means that I agree with their decision and may not have a good suit.

Ebay is going to stop me from selling and buying if I don't pay them. I have an attorney reviewing a class action suit against them for promoting fraud with their Buyer Protection Plan.

Has anyone here have this problem?????
The buyer did a Buyers Remorse on me or tried a scam to make me refund a small amount of her payment back to her. The plate (which is over 100 years old) had NO scratches on several of the grapes as she stated.
When she emailed me about the damage I asked her to send me photos of the damage so I could verify it. She never did but 4 days later filed a claim with Ebay. I called Ebay and stated what happened and the woman agreed with me that the buyer never sent photos but I could not file an appeal until I received it back and the case was closed.
I did file an appeal and Ebay sided with her again. I called Ebay again and stated what had happened. I was told that Ebay sided with her as she stated it was not as described. Ebay took her word as being true. The man I spoke to stated Ebay did overcharged me for the postage and he would issue a refund which he never did. I shipped her two items that she won in the same box and the plate only cost a $1 extra. If I pay her ½ the postage, she got the first item for less than ½ the actual postage cost and I would lose more money.
If Ebay would have done research before rewarding her the case they would see by her neg. feedback that she had pulled this over 20 times in the past. As no one wants a neg. feedback I am sure she did this many more times.
I have been a member of Ebay over 15 years and never had this happen before. My feedback is excellent as you can see.
I will now ship it back to her if she sends me $16.01 for postage and an additional $10 for repacking and taking it to the post office or I will ship it to you for $16.01 postage but I will not pay the amount Ebay is asking for as Ebay made this error. The plate had NO DAMAGE as all.
The Buyer is always right, not the seller under Ebay’s Buyer Protection Plan. Has this happened to any others??? -
